Personal Profile

Mr. Xia has been engaged in the legal profession since 2001 and has served as a judge in Guangzhou for more than 8 years. During his tenure, he has been in the front-line trial department, hearing a large number of civil and commercial litigation cases. After resignation, Mr. Xia, as a part-time arbitrator of Guangzhou Arbitration Commission, adjudicates nearly 100 cases every year. He has repeatedly expressed professional opinions on difficult cases as a member of the expert advisory committee, so he knows how the judges think. Providing effective and professional support for dispute resolution, Mr. Xia provides clients with solutions in multiple dimensions.

 

The cases represented by Mr. Xia cover various civil and commercial fields such as company equity, commercial contracts, financial loans, trusts, private equity, construction, real estate development, housing sales, etc. He is especially good at resolving corporate and financial-related disputes. Mr. Xia is currently the legal adviser of Shanghai Pudong Development Bank (Guangzhou Branch), Sony (Huizhou), TWS Guangzhou and other companies.

Representative Litigation and Arbitration Cases

• Mr. Xia was the agent for a property damage compensation dispute between several private investors and a bank and fund manager. In the event that the manager lost contact, the court ruled that the bank should compensate the client for more than 100 million yuan of economic losses.

• As the agent in the business trust contract dispute between a trust company and a local government financing platform in Guizhou Province, Mr. Xia enabled the trust company to realize more than 250 million yuan of creditor's rights.

• In a contract dispute between a trust company and a real estate company over perpetual bonds, Mr. Xia enabled the trust company to realize more than 150 million yuan of creditor's rights.

• As the agent for a dispute over the financial loan guarantee contract between a client and a bank, Mr. Xia exempted the client from more than 20 million yuan of debt because the court finally found that the mortgage guarantee was invalid.

• Mr. Xia represented a series of sales contract disputes between the epidemic materials company and many buyers, and ultimately won the lawsuit. This exempted clients from refunding debts of more than 100 million yuan.

• Mr. Xia once represented a cooperative development dispute between a group and a real estate company (concerning more than 700 million yuan).

• Mr. Xia was an agent for the share repurchase dispute between a trust company and a real estate company (the amount involved in the case exceeded 500 million yuan).

• Mr. Xia dealt with a property infringement dispute between a listed company and a bank due to illegal fund collection business.

• Mr. Xia dealt with a construction contract dispute between a construction engineering group company and a real estate company in Guangxi.

• Mr. Xia dealt with a construction contract dispute between a construction company and an agricultural science and technology company in Guangdong.

• Mr. Xia was an agent for a dispute between a listed company and a former senior executive over prohibition of business strife and infringement of trade secrets.

• Mr. Xia participated in the construction contract dispute between an energy construction group and a construction company.
